Terms and Conditions

These terms describe the conditions for Secureferry's digital services and set out the payment, subscription, cancellation, refund, and electronic delivery policies that apply to customer orders.

Current Android purchases are processed by Google Play. These terms also establish the customer policies for direct website checkout through Payfast when that checkout is made available. Applicable consumer rights take priority over any inconsistent wording in these terms.

1. Scope and acceptance

These Terms and Conditions ("Terms") describe the conditions on which SECUREFERRY ("Secureferry", "we", "us", or "our") offers its applications, websites, subscriptions, and related digital services (the "Services").

Before placing a direct website order, a customer will be given an opportunity to review, store, and affirmatively accept the version of these Terms then in force. The checkout must also allow the customer to identify and correct errors or withdraw before submitting the order. Publication of this page by itself is not treated as proof that a particular customer accepted a purchase.

Additional terms shown for a particular plan, offer, app store, or payment method form part of the order. If they conflict with these Terms, the checkout-specific term applies only to that order, unless doing so would reduce a right that cannot lawfully be limited.

3. Services and digital nature

Secureferry supplies access to its own digital software and network-routing services. The Services may include VPN and routing functionality, multiple or multi-hop routes, route locations, app and website assignments, shared routes, protection profiles, account controls, a web control panel, private networks, and Shared Services functionality.

The particular features, limits, supported devices, and locations included in a plan are those shown before purchase. Secureferry does not sell physical merchandise or third-party designer or name-branded goods. Its route and shipping terminology is a product metaphor; Secureferry does not provide courier, freight, transport, or physical logistics services. More detail appears on the Products and Services page.

Secureferry is a VPN and network-routing service. It does not promise anonymity, uninterrupted access to every location or third-party service, or that use of the Services will change obligations imposed by a customer's network provider, employer, platform, or applicable law.

No separate commercial guarantee applies unless a checkout expressly states one. All statutory service-quality rights, guarantees, and remedies remain available.

4. Accounts and eligibility

Paid access is linked to an authenticated Secureferry account. Customers must provide accurate account information, keep sign-in credentials secure, and promptly report suspected unauthorized access.

A customer must have legal capacity to enter the agreement. A person who does not have that capacity may use the Services only with the involvement and permission of a parent, guardian, or other person authorized by applicable law. An account and its paid entitlement may not be sold or transferred without Secureferry's written permission.

5. Plans, orders, prices, and records

Secureferry may offer free access and paid subscriptions. Current paid consumer subscriptions renew monthly unless a checkout expressly states another billing period or minimum duration. A free level of access is not a free trial and does not automatically convert into a paid plan.

Before payment, the checkout must identify the selected service, included capacity, total price, transaction currency, billing interval, renewal terms, applicable taxes or fees, and any minimum duration. Direct website transactions are stated in South African rand (ZAR), unless the checkout clearly offers another supported display currency.

An order is accepted only after the payment provider reports a successful transaction and Secureferry issues or makes available a confirmation. The payment provider or Secureferry account area provides a receipt or transaction record. Secureferry retains an order or transaction record for at least five years after the transaction, subject to any longer lawful retention requirement. During that period, a customer may request an electronic copy by emailing [email protected]. A confirmation made available at checkout may also be downloaded, printed, or stored by the customer.

6. Payments and recurring billing

Android purchases are currently processed by Google Play. When direct website checkout becomes available, those payments are intended to be processed by Payfast. The relevant provider's terms and privacy practices also apply to its payment service.

For a recurring direct website subscription, the checkout must disclose the amount, currency, frequency, charge date or clearly described billing schedule, and duration before the customer authorizes payment. Secureferry will retain a record of the customer's authorization as required and provide a confirmation containing the subscription information and cancellation route.

Unless cancelled, an auto-renewing subscription is charged at the start of each new billing period at the price disclosed for that renewal. Secureferry will provide notice and obtain any renewed confirmation required by law or the payment provider, including for material recurring-payment changes. A failed, reversed, or disputed payment may delay activation or place paid access on hold while the payment status is resolved.

7. Delivery policy

All paid Services are delivered electronically. There is no physical shipping, collection, or courier delivery. Delivery occurs when the purchased entitlement is applied to the authenticated Secureferry account after successful payment confirmation and transaction validation.

Activation normally follows payment confirmation promptly. If paid access is not visible within 24 hours, the customer should contact [email protected] with the account email and payment provider's order or transaction reference. Individual route or location preparation is a separate operational step and may take additional time.

If Secureferry cannot deliver the paid entitlement within the period agreed at checkout, or within 30 days where no different period was agreed, the customer may cancel the unfulfilled order and receive a refund as required by applicable law.

8. Cancellation policy

Cancel future renewal

A customer may cancel an auto-renewing subscription before the next renewal. There is no cancellation fee for ending future renewal of a month-to-month subscription. Cancellation normally stops future charges while paid access continues until the end of the current billing period, unless the subscription is refunded, revoked, or applicable law requires a different result.

How to cancel

  • For Google Play purchases, use Google Play subscriptions.
  • For a direct website subscription, use the cancellation method shown in the Secureferry account or purchase confirmation. If that method is unavailable, email [email protected]. The email creates a recorded cancellation request.

Deleting a Secureferry account does not by itself cancel a subscription managed by Google Play or another payment provider. Cancel the subscription first, then use the separate account-deletion process.

Qualifying fixed-term agreements

Where the Consumer Protection Act applies to a fixed-term consumer agreement, the customer may cancel on 20 business days' recorded notice. Secureferry will credit the remaining prepaid value after deducting only a reasonable cancellation charge where the law permits one. Nothing in these Terms removes a cancellation right granted by applicable law.

9. Refund policy

Initial direct website purchase

A natural person who makes an initial direct website subscription purchase may cancel without reason within seven days after the agreement is concluded. Secureferry will refund the amount paid within 30 days after receiving a valid cooling-off request. If applicable law grants a longer period or another remedy, that right also applies.

Direct marketing

If an agreement results from direct marketing and the Consumer Protection Act applies, the consumer may cancel in writing or another recorded form within five business days after the later of conclusion of the agreement or delivery of any goods. Secureferry will refund payments within 15 business days after receiving the cancellation notice, as that Act requires. Secureferry's Services are normally delivered digitally and do not involve goods.

Other eligible refunds

A full or appropriate partial refund or price reduction is also available where:

  • the paid entitlement is not delivered within the agreed or legally required period;
  • the Service does not meet the quality or timeliness standards required by law; where section 54 of the Consumer Protection Act applies, the customer may require Secureferry either to remedy the defect or to refund a reasonable portion of the price, having regard to the extent of the failure;
  • a customer is charged twice or charged an incorrect amount;
  • the payment provider confirms an incorrect or unauthorized transaction, or applicable law or payment rules require reversal; or
  • applicable law otherwise requires a refund, credit, or price reduction.

Outside these cases, fees for a completed or used billing period are not automatically refundable. Cancelling future renewal does not itself refund a charge already made. This wording does not limit cooling-off, defective-service, non-delivery, or other non-waivable consumer rights.

Google Play purchases

For a Google Play purchase, first use Google Play's refund request. Google may process the request or direct the customer to Secureferry depending on the purchase and timing. If the request is unresolved, email [email protected] with the order reference. Google Play's process does not remove rights available under applicable law.

Refund method and timing

Approved refunds are returned through the original payment method where the payment provider permits and will not exceed the original transaction amount. If that method cannot receive the refund, Secureferry and the customer will agree another lawful, documented method. Secureferry will provide or arrange a refund confirmation. Cooling-off refunds are made within the period stated above; other approved refunds are submitted promptly and within any applicable legal deadline. The payment provider or bank controls how long a submitted refund takes to appear. A refund may reduce or end the corresponding paid entitlement.

10. Service availability and changes

Secureferry works to keep the Services available but does not promise uninterrupted operation or permanent availability of every route, location, platform, or feature. Capacity, maintenance, security events, third-party networks, device compatibility, and legal restrictions may affect availability.

Secureferry may improve, replace, or discontinue a feature. If a material change removes the main paid benefit of an active plan, Secureferry will provide reasonable notice where practicable and any remedy required by law.

11. Acceptable use

Customers must not use or help another person use the Services to:

  • break applicable law or facilitate fraud or other unlawful conduct;
  • gain unauthorized access to an account, device, system, or network;
  • distribute malware, spam, phishing, impersonation, or abusive automated traffic;
  • harass, threaten, exploit, or unlawfully expose another person's data;
  • infringe intellectual-property, privacy, confidentiality, or other rights;
  • disrupt, overload, probe, reverse engineer where prohibited, or bypass security or service limits; or
  • resell an account, subscription, or Secureferry capacity without written permission.

A customer remains responsible for traffic and activity initiated through the customer's account and devices, subject to applicable law.

12. Intellectual property

Secureferry and its licensors retain their rights in the Services, software, designs, documentation, trademarks, and related materials. Subject to these Terms, Secureferry grants the customer a limited, non-exclusive, non-transferable right to use the Services for the customer's lawful purposes during the applicable access period.

Third-party and open-source components remain subject to their own licences. These Terms do not take away any right granted directly by an applicable open-source licence.

13. Privacy and payment security

Secureferry handles personal information as described in the Privacy Policy. Payment providers such as Google Play and Payfast process payment credentials under their own privacy and security terms. Secureferry receives transaction, product, subscription, and status information needed to validate payment and provide the Service.

Payment details must be entered only through the payment provider's checkout. Secureferry does not ask customers to email card details and does not store full payment card numbers or card security codes. The website transmits information over HTTPS.

14. Suspension and termination

Secureferry may restrict or suspend access where reasonably necessary to address non-payment, a material breach, fraud, abuse, a security threat, a legal requirement, or harm to the Services or others. Where appropriate, Secureferry will give notice and a reasonable opportunity to correct the issue.

Serious or repeated misuse may result in termination. Any suspension or termination remains subject to applicable consumer rights, including rights relating to prepaid value and defective or undelivered Services.

15. Responsibility and legal limits

Secureferry is responsible for providing the paid Service with the quality and care required by applicable law. No system can be guaranteed to be completely secure or continuously available, and customers should keep devices, accounts, and recovery methods appropriately protected.

To the extent permitted by law, Secureferry is not responsible for loss caused solely by a customer's unlawful use, compromised credentials the customer failed to report, unsupported device changes, or an external event beyond Secureferry's reasonable control. Nothing in these Terms excludes liability for fraud, gross negligence, wilful misconduct, or any liability or consumer remedy that law does not allow Secureferry to exclude.

16. Complaints and support

Send a billing, delivery, refund, cancellation, or service complaint to [email protected], or telephone 060 371 8887. Include the Secureferry account email, a concise description, relevant dates, and the payment provider's order or transaction reference. Do not include full card details or passwords.

Secureferry will investigate and communicate the outcome within a reasonable period. This process does not prevent a customer from approaching a payment provider, regulator, ombud, tribunal, or court where applicable.

17. Changes to these terms

Secureferry may update these Terms to reflect legal, payment, security, or Service changes. The page identifies its version and effective date. Material changes affecting an active recurring subscription will be communicated before they take effect, and Secureferry will obtain renewed acceptance where required. Changes do not retrospectively remove rights that arose under an earlier order.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. A dispute may be brought before a South African court, tribunal, regulator, or ombud with jurisdiction. If mandatory consumer law gives a customer the right to use another forum or the law of another place, these Terms do not remove that right.

If one provision is invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions continue to apply.
